Senior Attorney, RE & Construction Litigation

An established and fast-growing law firm client in Manhattan close to GCS/Penn), with strong pipeline, is hiring a Senior Attorney, RE & Construction Litigation and Transactions, a newly-created position due to growth, with a VERY clear and intended path to Partner! Base salary approximately $250k to $350k, possibly more (DOE), plus bonus, origination fees, 401k, and 100% firm paid FAMILY medical insurance coverage!

The firm specializes in representing RE & construction company owners, developers, architects, engineers, contractors and investors in NYC re Commercial RE & Construction Litigation and Transactional matters, including defects, mechanic's liens, project delays, contract disputes, encroachment, etc.

The Senior Attorney will be a leader within the firm, responsible for RPAPL 881 / adjoining property access matters, having a 'hands on' role in preparing, filing, negotiating, and reviewing 881 legal docs, appearing in court, etc., and owning 881 cases from inception to conclusion.

RPAPL 881 Statute Experience: In addition to broad RE & Construction transactional & litigation experience, candidates MUST HAVE reasonably strong, ‘hands on’ experience with:

• Preparing & filing petitions pursuant to RPAPL 881 litigation matters

AND / OR

• Preparing, negotiating, and reviewing license / adjoining property access agreements pursuant to RPAPL 881 transactional matters reflective of the statute's provisions, including scope & duration, license fees, insurance, indemnification, legal fee reimbursement, etc.

If the Senior Attorney has 'hands on' experience with ONE OR THE OTHER, BUT NOT BOTH OF THE ABOVE, the Partners WILL mentor and train the Senior Attorney to elevate their RPAPL 881 experience to the expert level in BOTH of the above areas of RPAPL 881.

Key Responsibilities:

• Own and perform all aspects of RPAPL 881 commercial RE & construction litigation and transactional matters from beginning to end
• Prepare and file RPAPL 881 petitions
• Prepare, negotiate, and review license / adjoining property access agreements pursuant to RPAPL 881 (w/ assistance from the firm’s paralegals)
• Appear in NY courts
• Oversee and help manage a few Associate Attorneys
• Perform legal research, discovery, analyze complex legal matters, prepare legal memoranda

Key Requirements:

• ~5-15 TOTAL yrs of litigation experience
• ~2+ yrs of recent experience handling litigation AND/OR transactional RPAPL 881 / adjoining property access matters, preferably from beginning to end
• NY J.D.
• Experience appearing in NY courts, preferably including Supreme Court.
• Analyze and research complex legal matters, perform discovery, prepare appropriate legal documents, and handle client litigation and transactions matters beginning to end
• Strong Contract Law experience
• Strong client relations experience
